Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the EstateXapp ecosystem (the "Service") operated by EstateXapp ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using our Service, specifically the Marketplace, Property Management tools, and Lead Generation systems, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Accounts and Membership

• Registration: You must provide accurate and complete information when creating an account. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
• Security: You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
• Professional Status: By registering as an "Agent" or "Member," you represent that you are authorized to conduct real estate business in your jurisdiction.

3. Subscription and Billing

Some parts of the Service (such as accessing Premium Leads or unlimited listings) are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (such as every 30 days).

• Payment: You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service.
• Cancellation: You may cancel your Subscription at any time. Your access will continue until the end of your current billing period.
• Refunds: Except when required by law, paid Subscription fees are non-refundable.

4. The Marketplace & User Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, or other material ("Content"). You are responsible for the Content that you post to the Marketplace.

• Accuracy: You agree only to list properties that are currently available and for which you have the authority to sell or rent. Fake listings ("Ghost Listings") used solely to generate leads are strictly prohibited.
• Leads: Client Requirements posted on the platform must be genuine. We reserve the right to remove any lead or listing that we deem suspicious or fraudulent.

5. Prohibited Activities

You agree not to engage in any of the following activities:

• Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
• Harass, threaten, or defraud other users (Agents or Clients).
• Attempt to reverse engineer the software or scrape data from the Marketplace.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

7. Financial Transactions Disclaimer

EstateXapp is a platform that facilitates connections between real estate professionals and clients. The company shall not be held responsible for any financial transactions, deals, or agreements made between agents, members, or clients. All financial dealings are solely the responsibility of the parties involved. Users are advised to exercise due diligence and caution when entering into any financial arrangements.

8. Legal Compliance & PECA Act 2016

Every user of EstateXapp is bound to comply with the Prevention of Electronic Crimes Act (PECA) 2016 and its 2025 amendments. Sharing any content on the app that violates Pakistani laws and state sanctity is strictly prohibited.

8.1 Prohibited Content

If any user is found guilty of the following serious violations, their account will be immediately blocked and their record will be sent to the National Cyber Crime Investigation Agency (NCCIA):

a) Blasphemy and Sacred Entities:

Sharing any disrespectful content (text, image, video) against Islam, any pillar of the religion, the Holy Prophet (P.B.U.H), other Prophets (A.S), the Companions, or Ahle-Bait is a serious crime. This can result in death penalty or life imprisonment under PECA and Pakistan Penal Code (PPC).

b) National Security & State Institutions:

Any propaganda, hate speech, or posts damaging the ranking against Pakistan's integrity, defense, and Armed Forces (Pakistan Army) are strictly prohibited. Under PECA Section 20 and 2025 new laws, this will be counted as "Anti-State Activities".

c) Contempt of Court:

Ridiculing the judiciary, wrongly criticizing judicial decisions, or disrespecting judges is legally a crime.

d) Fake News and Misleading Information (Section 26-A):

Spreading any false news regarding property or national affairs that causes fear and panic can result in imprisonment of up to 3 years under PECA 2025.

e) Hate Speech:

Spreading sectarianism, racism, or hate against any religious minority is prohibited under PECA and new Social Media Rules.

8.2 Monitoring and Enforcement

EstateXapp's management system and AI algorithms (as specified in SMPRA rules) monitor all activities on the platform.

• Zero Tolerance: Any violation mentioned above will result in immediate account termination without any notice.
• Reporting: It is every user's duty that if they see any post containing Blasphemy or Anti-State content, they should immediately use the "Report" button.

8.3 User Responsibility

The user confirms that they will use the platform only for Real Estate business. In case of any political, religious, or false statements, all legal liability will be solely on the user, not on EstateXapp administration.

9. Limitation of Liability

In no event shall EstateXapp, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
